Terms of Service

Last updated 30 July 2026. These terms govern your use of AddaBubba.

1. Welcome to AddaBubba

The AddaBubba mobile application, website, and related services (collectively, the "Service") are provided by S & H Industries Group of Companies Pty Ltd (ABN 36 684 927 946) ("AddaBubba", "we", "us"), PO Box 559, Miami QLD 4220, Australia. These Terms of Service ("Terms") and our Privacy Policy (incorporated by reference) govern your use of the Service. By accessing or using the Service, you agree to them. If you do not agree, do not use the Service.

Our Mission

AddaBubba exists to facilitate connections for private sperm donation and alternative family building, empowering individuals to form families through non-traditional paths in a safe, inclusive environment.

2. Your Privacy

Our Privacy Policy is the single source of truth for what we collect, how consent works (including for sensitive information and biometric identity verification), overseas processing, retention, security, and your rights — including how to complain to us and to the Office of the Australian Information Commissioner. Please read it; it forms part of these Terms.

3. Account and Eligibility

To access certain features, you must create an account and:

• Be at least 18 years old.
• Provide accurate, current information.
• Keep your account details and password secure.
• Be responsible for activity on your account.
• Notify us of unauthorized use at support@addabubba.app.

4. Community Guidelines

AddaBubba fosters respect and inclusivity. The following behaviours are prohibited:

• Disrespecting Family Choices: Judgment or harassment of others' sperm donation or family building preferences.
• Coercion: Pressuring or manipulating others; agreements must be consensual.
• App Hopping: Creating multiple accounts or misrepresenting intentions across platforms.
• Location Misrepresentation: Disguising your location to misrepresent where you are or to circumvent the Service's Australia-only availability.
• External Chats: Moving initial conversations outside the app (use AddaBubba for safety).
• Discrimination: Bias based on race, ethnicity, gender, orientation, or other protected traits.
• Nudity: Explicit content in profiles or messages.
• Misrepresentative Photos: Profile photos must be clear, recent images of yourself. No stock images, images of other people, or photos in which you cannot be identified.
• Catfishing: Misrepresenting identity or using fake personas.
• Criminal Activity: Use by those with violent, sexual, or fraudulent criminal backgrounds.
• Public Personal Details: Don't put your full name, street address, or contact details in your public profile — keep them to private chats.
• Inappropriate Messages: Sexual, harassing, or explicit communications.
• Unsolicited Fertility Comments: Remarks about others' fertility or reproductive issues.
• Aggressive Behaviour: Hostile or threatening interactions.

What we do and don't check: AddaBubba is an introductions platform. We verify identity before users can start conversations, but we do not conduct criminal background checks and do not screen, test, or supervise users. Exercise your own judgment, take sensible precautions, and obtain independent legal and medical advice before entering any conception arrangement.

5. User Content

You are responsible for all content you post ("User Content"). By submitting User Content, you grant AddaBubba a worldwide, non-exclusive, royalty-free licence to host, use, modify, and distribute it for the purposes of operating, moderating, and improving the Service. We will not use your photos or other identifying content in advertising or marketing without your separate, express consent. This licence ends when you delete the content or your account, except for copies we must retain for legal or safety reasons and short-lived backups that purge on their normal cycle. Do not post illegal, harmful, or objectionable content, or engage in unauthorized access or commercial activities without consent.

6. Fees

AddaBubba is currently free to use. If we introduce paid features, we will publish their terms — including pricing, billing, and refunds consistent with your rights under the Australian Consumer Law — before you are asked to pay for anything.

7. Termination

• By you: delete your account at any time in Settings, or by email — see our Delete Account page. Deletion of a suspended account is deferred while the safety matter is investigated.
• By us: we may suspend or terminate your account for breach of these Terms, giving you notice and, where lawful, the reason. We may suspend immediately and without prior notice where reasonably necessary to protect other users, prevent fraud, or comply with the law.
• If you believe we've got it wrong, contact support@addabubba.app and we will review.

8. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded, including that they will be provided with due care and skill.

9. Disclaimers

Subject to section 8: we do not guarantee uninterrupted access, error-free operation, match accuracy, or any outcome from connections made through the Service. AddaBubba is not a fertility clinic, medical service, or legal service, and nothing in the Service is medical or legal advice.

10. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be excluded or limited under Australian law. Subject to that and to section 8: neither party is liable to the other for indirect or consequential loss (including loss of profits, data, or goodwill); and where a consumer guarantee applies and the failure is not a major failure, our liability is limited to resupplying the affected services. Our total aggregate liability to you otherwise is limited to the greater of A$100 and the amounts you paid us in the 12 months before the claim.

11. Your Responsibility for Your Actions

You agree to compensate us for loss caused by third-party claims arising from your breach of these Terms or your unlawful use of the Service, except to the extent we caused or contributed to the loss.

12. Governing Law and Disputes

These Terms are governed by the laws of Queensland, Australia. If a dispute arises, contact support@addabubba.app first — we'll work with you in good faith to resolve it within 30 days. Unresolved disputes may be brought in the courts of Queensland or, where the law allows, the courts of your Australian state or territory. Nothing in this section prevents you from complaining to a regulator, including the OAIC or the ACCC.

13. Changes to These Terms

We may update these Terms. For material changes we will give you notice in the app or by email at least 14 days before they take effect; continued use after the effective date constitutes acceptance. If you do not agree to a change, stop using the Service and delete your account before the change takes effect.
