1. Welcome to AddaBubba

These Terms of Service ("Terms") govern your use of the AddaBubba mobile application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy (incorporated by reference), and to hold AddaBubba and its affiliates harmless from any legal responsibilities to the fullest extent permitted by law, even if the Limitation of Liability or Indemnification provisions are insufficient. If you do not agree, you must not use the Service.

Our Mission

AddaBubba exists to facilitate connections for private sperm donation and alternative family building, empowering individuals to form families through non-traditional paths in a safe, inclusive environment.

2. Your Privacy Rights in Queensland and Australia

As a user in Queensland or elsewhere in Australia, you are protected by the Privacy Act 1988 (Cth) and Queensland's Information Privacy Act 2009, including the Australian Privacy Principles (APPs).

Sensitive Information Consent

The Service collects sensitive information, such as reproductive health data (e.g., fertility status, family planning goals) and personal details, to connect users for sperm donation and family building. By using the Service, you consent to:

• Collection and processing of this information to provide the Service.
• Use by AddaBubba and third-party providers to match you with compatible users.
• Secure storage compliant with Australian privacy laws.

Your Rights

You can:

• Access your personal information.
• Request corrections or deletion.
• Opt out of marketing or certain data sharing.
• Lodge complaints with the Office of the Australian Information Commissioner (OAIC).

3. Data Collection and Third-Party Services

AddaBubba uses third-party services to enhance functionality. By using the Service, you consent to:

• Data collection, including personal identifiers, device info, user content, reproductive health data, and app usage.
• Processing by third parties (e.g., analytics, cloud storage, marketing) for service delivery, personalization, and improvement.
• Purposes like matching, analytics, and marketing.

Third parties receive only necessary data via APIs or SDKs. If you do not consent, do not use the Service. See our Privacy Policy for more.

4. Account Creation and Responsibilities

To access certain features, you must create an account and:

• Provide accurate, current information.
• Keep your account details and password secure.
• Be responsible for all account activities.
• Notify us of unauthorized use at support@addabubba.app.
• Be at least 18 years old.

5. Community Guidelines

AddaBubba fosters respect and inclusivity. The following behaviours are prohibited:

• Disrespecting Family Choices: Judgment or harassment of others' sperm donation or family building preferences.
• Coercion: Pressuring or manipulating others; agreements must be consensual.
• App Hopping: Creating multiple accounts or misrepresenting intentions across platforms.
• VPN Use: Disguising location or identity via VPNs.
• External Chats: Moving initial conversations outside the app (use AddaBubba for safety).
• Discrimination: Bias based on race, ethnicity, gender, orientation, or other protected traits.
• Nudity: Explicit content in profiles or messages.
• Catfishing: Misrepresenting identity or using fake personas.
• Criminal Activity: Use by those with violent, sexual, or fraudulent criminal backgrounds.
• Inappropriate Messages: Sexual, harassing, or explicit communications.
• Unsolicited Fertility Comments: Remarks about others' fertility or reproductive issues.
• Aggressive Behaviour: Hostile or threatening interactions.

Violations may result in account termination.

6. User Content

You are responsible for all content you post ("User Content"). By submitting User Content, you grant AddaBubba a worldwide, non-exclusive, royalty-free license to use, modify, and distribute it to provide and promote the Service. Do not post illegal, harmful, or objectionable content, or engage in unauthorized access or commercial activities without consent.

7. Privacy and Data Use

• Account details (email, phone, birth date).
• Profile data (photos, descriptions, preferences).
• Reproductive and family planning information.
• Messages within the app.
• Usage and device information.

Data Uses

• Deliver and improve the Service.
• Facilitate sperm donation and family building connections.
• Personalize experiences.
• Analyze usage, prevent fraud, and market the Service.

User Controls

• Adjust profile visibility and communication settings.
• Opt out of marketing.
• Request data access or deletion via privacy@addabubba.app.

8. No Public Disclosure of Personal Information

You must not share personally identifiable information (e.g., full name, address, health details) or characteristics publicly through profiles or posts. Use private, secure channels within the app. AddaBubba is not liable for consequences of public disclosures.

9. Termination

We may suspend or terminate your account at our discretion, without notice, for any reason, including breaches of these Terms.

10. Disclaimers

The Service is provided "as is" without warranties. AddaBubba does not guarantee uninterrupted access, error-free operation, match accuracy, or successful outcomes from connections.

11. Limitation of Liability

To the fullest extent permitted by Queensland and Australian law, AddaBubba, its affiliates, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, or losses of profits, data, or goodwill arising from your use of the Service.

12. Indemnification and Hold Harmless

You agree to indemnify, defend, and hold harmless AddaBubba, its affiliates, and agents from claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Service or violation of these Terms. By agreeing to these Terms, you explicitly hold AddaBubba harmless from any legal responsibilities, to the maximum extent permitted by law, even if the Limitation of Liability or Indemnification provisions are insufficient.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of Queensland, Australia. Legal actions shall be filed in Queensland courts, and you consent to their jurisdiction. Disputes (except those involving intellectual property, payments, or enforcement) shall be resolved through binding arbitration under the Australian Centre for International Commercial Arbitration rules, conducted in Queensland on an individual basis. You and AddaBubba waive any right to a jury trial.

14. Changes to Terms

We may update these Terms by posting revisions on our website or app. Continued use constitutes acceptance of the updated Terms.

BY USING THE SERVICE, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO THESE TERMS OF SERVICE, INCLUDING THE HOLD HARMLESS PROVISION. IF YOU DO NOT AGREE, CEASE USING THE SERVICE IMMEDIATELY.
